- 由於我國現今的能源政策係積極朝向發展再生能源與提倡電業自由化邁進，因此立法院遂於106年初通過《電業法》修正案。該《電業法》修正草案係先將原先之綜合電業，即台電公司，透過拆分的方式，將其分為發電業、輸配電業以及公用售電業。但由於上述三電業仍由一控股母公司掌控，因此在目前第一次修法僅要求做到廠網分工的情況下，我國電力市場實際上並未完全開放。然而，即使如此，我國發電業、輸配電業以及公用售電業實際上已經開始分別就其所負責的部分分工運作，故使得過去完全由一家綜合電業所負責的供電義務，在現行《電業法》之下，逐漸分別轉交由發電業、輸配電業以及公用售電業負責。因此本文將探討各供電義務在《電業法》上的定性與關係。此外，《電業法》第54條所規定之全日供電義務，要求公用售電業須負擔之全日供電義務，應另外輔以限縮解釋，僅限用戶電能供電義務，而不含系統電能供電義務及其他供電義務。同時當《電業法》第28條第1項電力排碳係數的規範與《電業法》第54條產生「義務衝突」時，公用售電業不得因此停止供電。

- Abatract
- In order to develop renewable energy and promote the liberalization of the power industry, congress passed an amendment of the Electricity Law in spring 2017. Currently, the Act intends to segregate the conglomerates in the power industry into generators, suppliers and retailers, therefore the ob-ligation of a steady power supply will be further clarified in this article, especially obligation of full day power supply.
