摘要
在「能源去中心化」之趨勢下,分散式電源、電動車、在地電能市場等倡議,正加速改變「配 電系統操作者」(Distribution System Operators)於電力系統中的定位。以歐盟為例,2030年前須達到 再生能源占總能源的32%,以及相較於現行水準提高32.5%的能源效率等目標下,歐盟以其2019第 944號指令(Directive (EU) 2019/944)規定「配電系統操作者」於電力市場中具有「中立的市場促進 者」、「分散式電源之採購者」、「市場價格訊號之發出者」以及「電力市場公平競爭之維護者」 等定位。我國規劃於2050年再生能源占總電力的60%至70%之目標,但2017年電業法之修法,考量 電網具有公用性及自然獨占特性,尚維持輸配電業以「政府獨家經營」為原則。我國與歐盟雖在地 理條件以及電力市場發展之背景有所不同,但歐盟對於「配電系統操作者」所建構之規範體系,仍 值得參考。本文從配電系統操作者上述四個市場定位為出發點,經由比較法觀點得出結論,並建議 我國電業及能源相關法規修正時,應以「提升用戶參與電力市場之機制」、「重視電力市場之競 爭」以及「強化對於電力資料之治理」為配電系統操作者之定位方針。期待此有助於強化電網韌 性、極大化永續綠能及淨零轉型之未來電力改革。

Abatract
Under the trend of “energy decentralization”, initiatives such as distributed energy resources, electric vehicles, and local electric energy markets have changed the positioning of “Distribution System Operators (DSO)” in the electric power system. Taking the European Union as an example, under the target of 32% for renewable energy sourcs in the European Union’s energy mix by 2030, and increasing energy efficiency by 32.5% compared to the current level, the European Union has adopted “Directive (EU) 2019/944” creating DSO with the positions of “neutral market facilitator”, “purchaser of distributed energy resources”, “market price signal sender” and “goalkeeper of fair competition” in the electricity market. Taiwan government plans to target renewable energy accounting for 60% to 70% of the total electricity supply by 2050. However, in the revision of the Electricity Act in 2017, considering the public utility nature and natural monopoly characteristics of the power grid, the principle of “government monopolized operation” for the power transmission and distribution industry is still maintained. Although there are differences between Taiwan and the European Union on geographical conditions and backgrounds for the development of the electricity market, the normative system established by the European Union for DSO still worth as a reference. This paper starts from the above-mentioned DSO four market positioning, through legal comparative methodologies to derive the conclusion, it is recommended that Taiwan’s electricity industry and energy-related regulations to be amended along with the goals of “enhancing the mechanism for customer to participate in the electricity market”, “emphasizing competition in the electricity market” and “strengthening the electricity data governance”. It is expected this will help strengthen the resilience of the power grid, maximize sustainable green energy and transformation of net-zero for future electricity reforms.
